Article 1: General Provisions

The e-commerce website of Studio Noticed is a sole proprietorship with its registered office at Rolweg 44, 8000 Bruges, VAT 0749.833.655, offering its customers the opportunity to purchase products from its webshop online.

These General Terms and Conditions apply to every order placed by a visitor of this e-commerce website. By placing an order via the webshop of www.studionoticed.com, the Customer must explicitly accept these Conditions, with which the Customer agrees to the applicability of these Conditions, to the exclusion of all other conditions. Additional conditions of the Customer are excluded, unless they have been previously, explicitly, and in writing accepted by Studio Noticed.

Article 2: Price

All mentioned prices are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer (excluding handling and shipping costs).

If delivery, reservation, or administrative costs are charged, this will be stated separately.

The price indication refers exclusively to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the offered information is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Studio Noticed.

Studio Noticed is only bound to a means obligation concerning the accuracy and completeness of the offered information. Studio Noticed is in no way liable in case of manifest material errors, typesetting, or printing errors. If the Customer has specific questions about, for example, dimensions, color, material, availability, delivery time, or delivery method, we request the Customer to contact our customer service in advance at hello@studionoticed.com. The offer is valid as long as stocks last and may be modified or withdrawn at any time by Studio Noticed. Studio Noticed cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.

Article 4: Online Purchases

The Customer has the choice between the following payment methods:

  • via credit card

  • via PayPal

  • via the electronic payment system MOLLIE

Studio Noticed is entitled to refuse an order due to a serious shortcoming of the Customer concerning orders involving the Customer.

Article 5: Delivery and Execution of the Agreement

Studio Noticed strives to make the purchased items ready for shipment (if in stock) within 2-3 working days after receipt of the full amount of the order. Packages are sent uninsured via Bpost, at the customer's risk and according to the applicable delivery terms. These terms are not binding. No delay can give rise to the dissolution of the purchase or to the payment of damages to the customer.

Orders are not processed on weekends and public holidays, and there are no deliveries on Saturdays. - Orders are shipped via Bpost

Please ensure that the delivery address is written correctly and that someone is always available to receive the ordered package at the delivery address (signature is required upon delivery) - if you know you will not be home, please select a pickup point as the delivery address. We are not responsible for loss or damage to goods once they have been delivered according to the established procedure. A usable delivery address is an address where someone is present for signing upon receipt of the order (not necessary for orders that can be placed in the mailbox, in Belgium) and is highly recommended. If the address is incorrect and the package is returned, the customer must pay the new transport costs (€ 5.70 for Belgium).

What are the shipping costs?

Belgium: €5.70

Unless otherwise agreed or expressly determined otherwise, the goods are delivered to the Customer's residence within 30 days of receipt of the order.

Any visible damage and/or qualitative shortcoming of an article or other shortcoming in delivery must be reported by the Customer immediately to hello@studionoticed.com within 2 days.

The risk of loss or damage passes to the Customer as soon as they (or a third party designated by them, who is not the carrier) have physically taken possession of the goods. However, the risk passes to the Customer upon delivery to the carrier if the carrier was instructed by the Customer to transport the goods and this choice was not offered by www.studionoticed.com.

Article 6: Retention of Title

The delivered items remain the exclusive property of www.studionoticed.com until full payment by the Customer.

The Customer undertakes, if necessary, to inform third parties of the retention of title of www.studionoticed.com, for example, to anyone who would seize the not yet fully paid articles.

Article 7: Right of Withdrawal

The provisions of this article apply only to Customers who, in their capacity as consumers, purchase goods online from www.studionoticed.com.

The Customer has the right to withdraw from the contract within 14 calendar days without giving any reason.

Please notify us if you wish to cancel your purchase before returning the goods. There is no entitlement to a refund if the product has been used, the packaging is damaged or written on, or the order was opened and/or not returned in the original packaging.

The direct costs of returning the goods are borne by the Customer.

The Customer is requested to return the items in their original condition and packaging, i.e., without traces of perfume or cigarette odor, not washed, without damage or other defect. If the returned product has somehow decreased in value, Studio Noticed reserves the right to hold the Customer liable and claim compensation for any depreciation of the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to determine the nature, characteristics, and functioning of the goods

All returned items are carefully examined. The principle here is that the consumer may only inspect the item as he would be allowed to do in a store. Returned items may be fitted but not used. When an item has decreased in value due to the Customer's use, this will be charged to the Customer.

If the Customer withdraws from the contract, Studio Noticed will refund all payments received from the Customer up to that point, excluding the standard delivery costs, to the Customer within a maximum of 14 calendar days after Studio Noticed has been informed of the Customer's decision to withdraw from the contract. In sales contracts, Studio Noticed can wait with the refund until it has received all the goods back or until the Customer has demonstrated that they have returned the goods, whichever comes first.

Any additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery offered by Studio Noticed will not be refunded.

Studio Noticed will refund the Customer using the same payment method used by the Customer for the original transaction unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charged any fees for such a refund.

Article 8: Warranty

Under the law of September 21, 2004, concerning the protection of consumers when selling consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights. To invoke the warranty, the Customer must be able to present a purchase receipt. Customers are advised to keep the original packaging of the goods. For articles that were purchased online and delivered to the Customer's home, the Customer should contact Studio Noticed customer service and return the article at their own expense to Studio Noticed.

If your package has arrived damaged, you must report this within 2 days via hello@studionoticed.com, with attached photos.

The (commercial and/or legal) warranty is never applicable to defects arising as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions or manual, modifications or changes to the article, rough handling, poor maintenance, or any other abnormal or incorrect use. Defects that manifest after a period of 14 days following the date of purchase, if applicable delivery, are deemed not to be hidden defects unless proven otherwise by the Customer.

Article 10: Force Majeure

Studio Noticed can never be held liable for the partial or complete non-fulfillment of its obligations due to force majeure. Force majeure may include (but is not limited to this list): fire, storm or severe weather, flooding, war, attacks, strikes, lockouts, interruptions of postal services and/or communication means, etc.

Article 11: Privacy

The data controller, Studio Noticed, respects the Belgian law of December 8, 1992, concerning the protection of privacy in the processing of personal data.

Ordering on Studio Noticed automatically implies that you allow us to use your personal data for all aspects of customer management: administration, order management, deliveries, marketing, and advertising.

Studio Noticed will never share this data with third parties. You can also request access to this data at any time or ask to have it changed or deleted. If you no longer wish to receive emails from us, you can have yourself removed from our address file. Just send a message to hello@studionoticed.com.

We treat your data as confidential information and will not pass it on, rent, or sell it to third parties. The customer is responsible for keeping their login details and password confidential. Your password is stored encrypted, so Studio Noticed does not have access to your password. Studio Noticed keeps online (anonymous) visitor statistics to see which pages of the website are visited to what extent. Article 12: Use of Cookies

During a visit to the site, 'cookies' may be placed on your computer's hard drive. A cookie is a text file placed by a website server in your computer's browser or on your mobile device when you consult a website. Cookies cannot be used to identify individuals, a cookie can only identify a machine.

‘First party cookies’ are technical cookies used by the visited site itself and aim to make the site function optimally. For example, settings that the user made during previous visits to the site, or even a pre-filled form with data that the user did during previous visits.

‘Third Party cookies’ are cookies that do not originate from the website itself but from third parties, for example, a present marketing or advertisement plug-in. For such cookies, the site visitor must first give permission – this can be done through a bar at the bottom or top of the website, referring to this policy, which does not prevent further surfing on the website.

Article 13: Impairment of Validity - Non-Waiver

If any provision of these Conditions is declared invalid, illegal, or null, this will in no way affect the validity, legality, and applicability of the other provisions. Failure at any time by Studio Noticed to enforce any of the rights listed in these Conditions, or to exercise any right thereof, will never be considered a waiver of such provision and will never affect the validity of these rights.

Article 14: Change of Conditions

These Conditions are supplemented by other conditions explicitly referred to, and the general sales conditions of Studio Noticed. In case of contradiction, these Conditions prevail.

Article 15: Property Rights and Copyright

The customer must respect all intellectual and industrial property rights resting on the articles delivered by Studio Noticed. Nothing from this website may be stored, used, or linked without written permission from Studio Noticed.

Article 16: Applicable Law – Disputes

All disputes related to or arising from (the use of) the website will be exclusively subject to Belgian law. The Belgian courts have exclusive jurisdiction to act in these disputes. The use of this website is not permitted in countries where all provisions of these terms, including this paragraph, are not applicable. A printed version of these General Terms and Conditions and any notice delivered in electronic form will be accepted in any judicial or administrative proceedings arising from or related to these General Terms and Conditions, to the same extent and under the same conditions as other documents and commercial records originally created and maintained in printed form. All rights not expressly granted in this document are reserved.
